These Terms of Service ("Terms") govern your access to and use of HazardHarbor, including the website at https://hazardharbor.online, the HazardHarbor workspace and related services (the "Service"), provided by HazardHarbor ("HazardHarbor", "we", "us"). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it, and "you" includes that organization.
1. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to use the Service.
You must provide accurate information, keep your email address current, and keep your password and any two-factor recovery codes confidential. You are responsible for activity under your account. Notify us promptly at the contact details below if you suspect unauthorized access.
Usernames must not impersonate others or infringe anyone's rights. We may reclaim or change usernames that violate these Terms.
2. What the Service is — and is not
HazardHarbor provides planning, organization and documentation tools for workplace safety and environmental programs, plus links to independent official resources. It is not legal, engineering, medical or compliance advice, and it does not certify, approve or guarantee compliance with OSHA, EPA or any other law, standard or permit.
The Service does not monitor your records, does not notify emergency services, supervisors or regulators, and does not file any report or form on your behalf. Do not rely on the Service for emergency response.
HazardHarbor is independent and is not affiliated with, endorsed by or sponsored by OSHA, EPA, NIOSH, FEMA, BLS or any government agency.
Your obligations when using the Service are described in our User Responsibilities, which form part of these Terms.
3. Plans, trials and billing
The Explorer plan is free. Paid plans (Coordinator and Team) are billed in advance on a monthly or yearly basis through our payment processor, Stripe, and renew automatically at the end of each billing period at the then-current price until cancelled.
Your first subscription to a paid plan may include a 14-day free trial. If you start a trial without a payment method and do not add one before it ends, the subscription ends automatically and you are not charged. If you add a payment method, billing begins when the trial ends unless you cancel before then.
Prices are shown in U.S. dollars and exclude applicable taxes, which may be added where required. We will give you at least 30 days' notice of any price increase to an existing subscription, which takes effect at your next renewal after the notice period.
If a payment fails, we and Stripe may retry the charge. If payment cannot be collected, your workspace may return to the Explorer plan; your records are not deleted.
Cancellation and refunds are governed by our Cancellation & Refunds Policy.
4. Your content
You retain all rights to the information you enter into the Service ("Your Content"). You grant us a limited license to host, store, process, back up, display and transmit Your Content solely to provide, secure and support the Service for you and your workspace members.
You are responsible for Your Content and for having the right to enter it. Do not enter medical or health records, Social Security numbers, financial account numbers or other sensitive personal information; the Service is not designed to protect that kind of data to the standards it requires.
In a shared Team workspace, records belong to the workspace, and the workspace owner controls membership. Members can see and edit workspace records according to their role.
You can export Your Content at any time. Data retention and deletion are described in our Data & Deletion Policy.
5. Our content and intellectual property
The Service — including its software, design, text, checklists, program outlines, toolbox talks, graphics and the HazardHarbor name and logo — is owned by HazardHarbor or its licensors and protected by copyright, trademark and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal business purposes in accordance with these Terms.
You may adapt, print and use checklists, outlines and talks within your own organization. You may not sell, sublicense, republish or redistribute our content or create a competing product from it.
Links to third-party resources are provided for convenience. We do not control and are not responsible for third-party sites or their content.
6. Acceptable use
You must follow our Acceptable Use Policy. Among other things, you must not attempt to access other users' data, probe or disrupt the Service, scrape it with automated tools, frame it, reverse engineer it except where the law allows, or use it unlawfully.
7. Feedback
If you send us suggestions or feedback, we may use them without obligation to you.
8. Suspension and termination
You may stop using the Service and delete your account at any time from Account → Data & privacy.
We may suspend or terminate access if you materially breach these Terms, create risk or legal exposure for us or others, or fail to pay, after giving notice where reasonable. Where practical we will give you an opportunity to export Your Content.
Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability and governing law) survive.
9. Disclaimers
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CONTENT IS CURRENT OR COMPLETE, OR THAT USE OF THE SERVICE WILL PREVENT INJURY, ILLNESS, ENVIRONMENTAL HARM, PENALTIES OR CITATIONS.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, OR FOR FINES, PENALTIES OR CITATIONS, ARISING OUT OF OR RELATING TO THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM AND (B) USD $100.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnity
You will defend and indemnify us against third-party claims arising from Your Content, your use of the Service in breach of these Terms, or your violation of law, except to the extent caused by our own breach.
12. Governing law and disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Courts located in that jurisdiction have exclusive jurisdiction, except that either party may seek relief in small-claims court where eligible. Consumer protection rights that cannot be waived under the law of your residence are not affected.
13. Changes
We may update these Terms. For material changes we will notify account holders by email or in the Service at least 30 days before they take effect, unless a change is required sooner by law or for security. Continuing to use the Service after changes take effect means you accept them.
